1. Definitions

In these Terms and Conditions, the following expressions have the meanings set out below:

Site means the address or location where the Services are to be carried out.

2. Scope of Services

Rubbish Removal Finchley provides waste collection and removal services to residential, commercial, and other customers. The exact scope of the Services will be as described in our quotation, booking confirmation, or other written communication with the Customer.

The Customer is responsible for ensuring that the description, volume, and type of waste provided to us at the time of booking is accurate. If, on arrival, the Waste materially differs from the description or quantity provided, we reserve the right to adjust the price, amend the Services, or decline the job.

We do not undertake building work, dismantling of fixed structures, specialist cleaning, pest control, or any other work not expressly included in the agreed Services. Light dismantling of loose items may be undertaken at our discretion and may incur additional charges.

3. Booking Process

Bookings may be made by telephone, email, online form, or any other method we approve from time to time. A booking is not confirmed until we have provided a confirmation, which may be verbal or written, including details of the Services, estimated or fixed price, date, and approximate time window.

The Customer is responsible for providing accurate contact details, Site address, access information, parking information, and a clear description of the Waste. This allows us to plan the collection, allocate an appropriate vehicle, and ensure compliance with waste regulations.

We may request photographs or a detailed list of items in order to provide a more accurate estimate. Any estimate based on incomplete or inaccurate information may be revised on Site.

We aim to arrive within the agreed time window but cannot guarantee exact arrival times due to traffic, weather, or operational factors. We will use reasonable efforts to keep the Customer informed of any significant delays and to re-schedule if required.

4. Quotations and Pricing

Quotations may be provided as estimated or fixed prices. Where an estimated price is given, it is based on the information supplied at the time of booking and on our standard load sizes, weights, and disposal costs.

On arrival at the Site, our operatives will assess the Waste and confirm the final price before commencing the Services. If the volume, weight, or nature of the Waste differs from that previously described, we may adjust the price to reflect the actual load and any additional disposal costs.

Prices generally take into account factors such as volume, weight, access difficulties, parking costs, and the type of waste. Special or hazardous items may attract additional charges or may not be accepted at all. All prices are subject to any applicable taxes as required by law.

5. Payments

Unless otherwise agreed, payment is due on completion of the Services on the day of collection. We may accept payment by cash, bank card, bank transfer, or other methods communicated to the Customer in advance.

For business customers, it may be possible to agree credit terms. Any such arrangements must be confirmed in writing. Invoices issued with agreed credit terms must be paid in full by the due date stated on the invoice.

We reserve the right to charge interest on overdue amounts at the maximum rate permitted by law and to recover all reasonable costs incurred in pursuing late payment, including administrative and legal costs.

Where a deposit or pre-payment is required to secure a booking, the booking will not be treated as confirmed until such payment has been received. Deposits may be retained or applied against cancellation charges in accordance with these Terms and Conditions.

6. Access, Parking, and Customer Obligations

The Customer must ensure that our operatives have safe and reasonable access to the Site at the agreed time. This includes providing correct entry instructions, arranging for someone to be present where needed, and clearing any obstacles that would prevent the safe movement of Waste from the premises to our vehicle.

The Customer is responsible for arranging suitable parking or providing information on local parking options. Any parking fees, fines, or penalties incurred as a direct result of the Customer failing to provide suitable parking or accurate information may be added to the final bill.

The Customer must ensure that the Waste presented for collection is not contaminated with hazardous materials, sharp objects, or substances that may endanger our operatives, the public, or the environment. We reserve the right to refuse to handle any item or material that we reasonably consider unsafe or prohibited.

7. Cancellations, Rescheduling, and Waiting Time

The Customer may cancel or reschedule a booking by providing notice via telephone or email. Where at least 24 hours notice is given before the scheduled arrival time, any deposit may be refunded or applied to a rebooked service at our discretion.

Where less than 24 hours notice is provided, we may charge a cancellation fee to cover our administrative and operational costs, including loss of slot. This fee may be deducted from any deposit already paid.

If our operatives attend the Site at the agreed time and are unable to gain access, or if the Customer is not present where required and has not provided alternative access arrangements, we may charge an attendance fee and treat the booking as cancelled.

Where our operatives are kept waiting at the Site for reasons beyond our control, we may apply reasonable waiting time charges after an initial grace period. Any such charges will be explained to the Customer and added to the final invoice.

8. Items We Cannot Collect

There are certain items and types of waste that we cannot legally or safely collect, transport, or dispose of. These may include, without limitation, asbestos, clinical or medical waste, explosives, gas bottles, chemicals, solvents, oil, paint in liquid form, and any other hazardous or controlled substances.

If such items are discovered among the Waste on arrival at the Site, we may refuse to collect them and may, at our discretion, refuse to proceed with the Services or adjust the price accordingly. The Customer remains responsible for arranging lawful disposal of any prohibited items.

9. Waste Handling and Environmental Compliance

Rubbish Removal Finchley is committed to handling Waste in accordance with applicable waste management and environmental regulations in the United Kingdom. We will use licensed disposal, recycling, or recovery facilities as appropriate for the type of Waste collected.

By presenting Waste for collection, the Customer warrants that they have the right to dispose of such items and that the Waste is not stolen, unlawfully obtained, or subject to third-party claims. The Customer agrees to indemnify us against any claims arising from the unlawful disposal of items supplied by them.

We may provide, on request and where applicable, a waste transfer note or other documentation evidencing the lawful transfer of Waste. The Customer must retain any such documentation as part of their own compliance records where required.

10. Damage and Liability

We will take reasonable care when carrying out the Services. However, the Customer accepts that minor scuffs or marks may occur where large or heavy items are moved through tight spaces. The Customer is responsible for protecting floors, walls, and fixtures if they are particularly delicate or at risk of damage.

Rubbish Removal Finchley shall not be liable for any pre-existing damage to property, fixtures, fittings, or belongings, nor for any damage that arises as a direct consequence of defects or weaknesses in the premises, including but not limited to loose carpets, unstable flooring, or poorly secured fixtures.

To the fullest extent permitted by law, our liability for any loss or damage arising from the performance of the Services shall be limited to the amount paid or payable for the specific job in question. We shall not be liable for any indirect, consequential, or economic loss, including loss of profit, business interruption, or loss of opportunity.

Nothing in these Terms and Conditions excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot lawfully be excluded or limited.

11. Customer Property and Left Items

The Customer is responsible for ensuring that no items intended to be retained are left among the Waste to be removed. Our operatives may, as a courtesy, confirm which items are to be taken, but the final responsibility rests with the Customer.

Once Waste has been loaded onto our vehicle and removed from the Site, it may not be possible to retrieve specific items. We do not accept liability for any loss arising where items were mistakenly presented as Waste.

12. Insurance

Rubbish Removal Finchley maintains insurance policies appropriate to the nature of its Services. Details of our insurance cover can be made available on request. It remains the Customer's responsibility to maintain adequate insurance for their own property and belongings.

13. Force Majeure

We shall not be in breach of these Terms and Conditions nor liable for any delay in performing, or failure to perform, any of our obligations where such delay or failure results from events, circumstances, or causes beyond our reasonable control. These may include, but are not limited to, extreme weather, accidents, road closures, strikes, acts of terrorism, or disruptions to utilities and essential services.

In such circumstances, we will use reasonable efforts to notify the Customer and to re-arrange the Services as soon as reasonably practicable.

14. Complaints and Disputes

If the Customer is dissatisfied with any aspect of the Services, they should notify us as soon as possible, ideally within 48 hours of completion. We will investigate any complaint and aim to resolve it promptly and fairly.

Where a dispute cannot be resolved informally, the parties may consider mediation or other forms of alternative dispute resolution before resorting to legal proceedings, although this does not restrict any statutory rights the Customer may have.

15. Data Protection and Privacy

We will collect and use personal information provided by the Customer for the purpose of administering bookings, delivering the Services, processing payments, and communicating about our services. We will handle such information in accordance with applicable data protection laws in the United Kingdom.

We will not sell personal information to third parties. We may share information where necessary with payment processors, insurers, or regulatory authorities, or where we are legally required to do so.

16. Amendments to Terms and Conditions

Rubbish Removal Finchley may amend these Terms and Conditions from time to time. The version in force at the time of the Customer's booking will apply to that specific booking. Updated terms may be made available upon request or published as part of our standard documentation.

17. Governing Law and Jurisdiction

These Terms and Conditions, and any dispute or claim arising out of or in connection with them or their subject matter, shall be governed by and construed in accordance with the laws of England and Wales.

The parties submit to the exclusive jurisdiction of the courts of England and Wales in relation to any dispute or claim arising under or in connection with these Terms and Conditions or the provision of the Services.

18. Severability

If any provision of these Terms and Conditions is found by a court or other competent authority to be invalid, unlawful, or unenforceable, such provision shall be severed from the remaining provisions, which shall continue to be valid and enforceable to the fullest extent permitted by law.

19. Entire Agreement

These Terms and Conditions, together with any written quotation or booking confirmation provided to the Customer, set out the entire agreement between Rubbish Removal Finchley and the Customer in relation to the Services. The Customer acknowledges that they have not relied on any statement, promise, or representation that is not expressly set out in this agreement.
